Military Accident Claims and Compensation

If you have been injured in a military accident it may be possible to make a claim.

Forces personnel put their lives at risk every time they go out on active duty, but their employer – the Ministry of Defence – has a responsibility to reduce the risk as far as possible.

This means proper equipment should be provided and it should be properly maintained and fit for purpose at all times.

If it is not, or if you are knowingly put at undue risk in your work, you could be entitled to make a military accident claim.

It is also possible to claim for emotional trauma as a result of your service if you have suffered mental health problems that affect your quality of life and that could have been prevented or minimised.

To win military accident compensation it must be shown that steps should have been taken to prevent your injury or condition.

This could mean you were not given proper protective clothing or forced to use sub-standard equipment and suffered an injury or illness as a result.

Proving negligence or irresponsible behaviour on the part of the MOD can be difficult, so clear evidence is required, such as medical reports and statements from officers.
